Origins of the Dispute
The trial revolves around the founding of OpenAI in 2015, primarily funded by Musk. Both Musk and Altman have expressed a desire for OpenAI to develop AGI responsibly, benefiting humanity rather than serving individual interests. A jury of nine individuals from the San Francisco Bay Area will determine the veracity of the claims made by both sides.

Musk’s Intentions and Skepticism

He remarked, “I was concerned AI would be a double-edged sword.” During his testimony, Musk reiterated that he could have established OpenAI as a for-profit entity but chose the nonprofit route for the public good.
Judge Gonzalez Rogers expressed skepticism regarding Musk’s intentions, noting that he is currently developing a competing AI company, xAI, which launched in 2023 and has since merged with SpaceX.
OpenAI’s Defense and Future Implications
OpenAI’s representatives assert that their mission is to serve the public interest. Greg Brockman, co-founder and president of OpenAI, emphasized that the technology being developed is transformative and transcends corporate interests. He maintained that Musk sought unilateral control over OpenAI, recalling a meeting where Musk initially appeared amenable to Altman’s leadership but later insisted that “people needed to know he was in charge.”
In addition to seeking damages, Musk is pursuing Altman’s removal from OpenAI’s board. A ruling in Musk’s favor could significantly impact OpenAI’s plans for an initial public offering.
