Trump Makes Historic First as Sitting President at Supreme Court Arguments on Birthright Citizenship
US President Donald Trump made a historic appearance at the Supreme Court on Wednesday, attending oral arguments concerning the legality of a policy central to his immigration agenda. This directive, signed on his first day back in office last year, aims to limit birthright citizenship.
Trump’s Attendance at the Supreme Court
Seated in the first row of the ornate courtroom, Trump left shortly after the administration’s lawyer concluded their presentation, just as the attorney for the challengers began. Accompanied by Secret Service personnel, he departed quietly. Arriving via motorcade from the White House, Trump was dressed in a dark suit and a red tie.
As the court session commenced, attendees, including Trump, stood as the court marshal announced, “Oyez! Oyez! Oyez!” marking the beginning of the proceedings. Trump spent approximately an hour and a half in the courthouse, seated next to White House Counsel David Warrington, with Commerce Secretary Howard Lutnick and Attorney General Pamela Bondi in the same row.
According to Clare Cushman, the resident historian at the Supreme Court Historical Society, Trump is the first sitting president to attend oral arguments at the Supreme Court.
Court’s Skepticism Towards Trump’s Directive
The arguments lasted over two hours, during which members of the court expressed skepticism regarding Trump’s directive. A ruling is anticipated by the end of June. Following his return to the White House, Trump posted on his Truth Social platform, stating, “We are the only Country in the World STUPID enough to allow ‘Birthright’ Citizenship.”
The United States is one of 33 countries that implement automatic birthright citizenship policies, as reported by the Pew Research Center. Critics argue that Trump’s directive is unconstitutional and rooted in racially discriminatory views against immigrants.
Demonstrators and Security at the Courthouse
Outside the neoclassical courthouse on Capitol Hill, demonstrators gathered ahead of the arguments, some holding signs that read “Trump must go now.” Chief Justice John Roberts did not acknowledge Trump’s presence before announcing the beginning of the case known as Trump v. Barbara. Increased security personnel were evident in the courtroom.
The Supreme Court has previously supported Trump in several emergency rulings since his return to the presidency, addressing issues such as immigration, federal layoffs, and foreign aid. However, on February 20, the court ruled against Trump in a significant case regarding the legality of global tariffs he imposed last year under a national emergency law.
Trump’s Reaction to Supreme Court Decisions
Following the tariffs ruling, Trump has publicly criticized the Supreme Court and the six justices who ruled against him. The court’s conservative majority, which includes three justices appointed by Trump—Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett—has faced scrutiny from the president. Trump has denounced judges who oppose his policies, often using personal language.
Three conservative justices, including Chief Justice Roberts, Gorsuch, and Barrett, sided with the court’s liberal members in ruling that Trump overstepped his authority with the tariffs. Trump expressed particular anger towards Gorsuch and Barrett, labeling them “an embarrassment to their families.”
In recent comments, Trump reiterated his discontent with his appointees, stating they “sicken me because they’re bad for our country.” He expressed shame over the three conservative justices who ruled against him, calling them “fools and lapdogs for the RINOs and the radical-left Democrats.”
Legal Challenges to Trump’s Executive Order
A lower court has blocked Trump’s executive order that directed US agencies not to recognize the citizenship of children born in the United States if neither parent is an American citizen or legal permanent resident. Trump previously stated on social media that “Birthright Citizenship was not meant for people taking vacations to become permanent Citizens of the United States of America, and bringing their families with them, all the time laughing at the ‘SUCKERS’ that we are!”
